CUSTOM LICENSE AGREEMENT

Effective Date: January 10, 2025

This Custom License Agreement (“Agreement”) governs the use of the FitWit Fintness tracking (“App”), a mobile application designed to provide users with advanced AI-powered speech and translation features, including Speech to Text, Text to Speech, Real-Time Translation, and Multi-Language Support. By downloading, installing, or using the App, you (“User”) agree to be bound by the terms of this Agreement. If you do not agree, you must not use the App.

1. Grant of License

1.1 License: The App is licensed, not sold, to the User for personal, non-commercial use under the terms of this Agreement.

1.2 Limitations: Users may not modify, distribute, sell, or sublicense the App or its content. Any attempt to do so is a breach of this Agreement.

2. Disclaimer of Liability

2.1 General Information: The App provides speech and translation functionalities, including but not limited to Speech to Text, Text to Speech, and Real-Time Translation, for convenience and accessibility. It is not intended to provide professional, medical, legal, or other specialized advice.

2.2 Accuracy: While the App aims to provide accurate translations and speech features, no guarantees are made regarding the correctness or completeness of the translations or text-to-speech outputs. Users are encouraged to verify critical translations or spoken content independently.

3. User Obligations

3.1 Accurate Information: Users agree to provide accurate and up-to-date input (such as text and voice) for the app’s functionality to work as intended.

3.2 Compliance: Users must use the App in compliance with all applicable laws and regulations, including copyright, privacy, and intellectual property laws.

3.3 Age Restriction: Users must be at least 13 years old to use the App. Minors must have parental consent.

4. Subscription Plans

4.1 Pricing:

• Weekly Subscription: USD $1.99

• Monthly Subscription: USD $4.99

• Yearly Subscription: USD $19.99

4.2 Auto-Renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.

4.3 Cancellation: Users may manage subscriptions and turn off auto-renewal in their iTunes Account settings.

4.4 Charges: The User’s iTunes Account will be charged upon purchase confirmation and at the beginning of each renewal period.

5. Privacy Policy

The use of the App is subject to the Privacy Policy, which governs the collection, use, and storage of User data. By using the App, Users consent to the practices described in the Privacy Policy.

6. Limitation of Liability

6.1 No Warranty: The App is provided “as is” without any warranty of any kind, including accuracy, reliability, or fitness for a particular purpose.

6.2 Limited Liability: The App Developer is not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the App.

7. Intellectual Property

The App, its design, and all related materials are the intellectual property of [Your Company Name]. Unauthorized use or reproduction is strictly prohibited.

8. Termination

This Agreement remains effective until terminated. The Developer may terminate the Agreement if the User breaches any term. Upon termination, the User must delete all copies of the App.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any disputes shall be resolved in the courts of [Your Jurisdiction].

10. Changes to Terms

The Developer reserves the right to update or modify this Agreement at any time. Continued use of the App constitutes acceptance of the revised terms.

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THIS LICENSE AGREEMENT.
