CUSTOM LICENSE AGREEMENT

Effective Date: January 10, 2025

This Custom License Agreement (“Agreement”) governs the use of the Relaxation Haven mobile application (“App”), designed to provide users with mindfulness and relaxation features, including calming music, guided meditations, personalized relaxation plans, stress-tracking, and daily mindfulness tips. By downloading, installing, or using the App, you (“User”) agree to be bound by the terms of this Agreement. If you do not agree, you must not use the App.

1. Grant of License

1.1 License: The App is licensed, not sold, to the User for personal, non-commercial use under the terms of this Agreement.

1.2 Limitations: Users may not modify, distribute, sell, or sublicense the App or its content. Any attempt to do so is a breach of this Agreement.

2. Disclaimer of Liability

2.1 General Information: The App provides features such as calming music, guided meditations, personalized relaxation plans, and stress-tracking for relaxation and mindfulness purposes. It is not intended to provide professional, medical, or therapeutic advice.

2.2 Accuracy: While the App aims to deliver effective relaxation and stress management tools, no guarantees are made regarding the effectiveness or accuracy of the relaxation plans or stress-tracking functionalities. Users should seek professional advice for medical or psychological conditions.

3. User Obligations

3.1 Accurate Information: Users agree to provide accurate and up-to-date information (such as stress levels or preferences) to ensure that the App’s functionality works as intended.

3.2 Compliance: Users must use the App in compliance with all applicable laws and regulations, including copyright, privacy, and intellectual property laws.

3.3 Age Restriction: Users must be at least 13 years old to use the App. Minors must have parental consent.

4. Subscription Plans

4.1 Pricing:

• Weekly Subscription: USD $1.99

• Monthly Subscription: USD $4.99

• Yearly Subscription: USD $19.99

4.2 Auto-Renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.

4.3 Cancellation: Users may manage subscriptions and turn off auto-renewal in their iTunes Account settings.

4.4 Charges: The User’s iTunes Account will be charged upon purchase confirmation and at the beginning of each renewal period.

5. Privacy Policy

The use of the App is subject to the Privacy Policy, which governs the collection, use, and storage of User data. By using the App, Users consent to the practices described in the Privacy Policy.

6. Limitation of Liability

6.1 No Warranty: The App is provided “as is” without any warranty of any kind, including accuracy, reliability, or fitness for a particular purpose.

6.2 Limited Liability: The App Developer is not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the App.

7. Intellectual Property

The App, its design, and all related materials are the intellectual property of Us. Unauthorized use or reproduction is strictly prohibited.

8. Termination

This Agreement remains effective until terminated. The Developer may terminate the Agreement if the User breaches any term. Upon termination, the User must delete all copies of the App.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes shall be resolved in the courts of India.

10. Changes to Terms

The Developer reserves the right to update or modify this Agreement at any time. Continued use of the App constitutes acceptance of the revised terms.

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THIS LICENSE AGREEMENT.
